1. Scope & Definitions

These Terms of Service (“Terms”) govern your use of PreViral.ai (“Service”, “Platform”), a SaaS platform for video content performance prediction operated by:

By creating an account or using the Service, you agree to these Terms. If you do not agree, you may not use the Service.

• “User”, “you” — any natural person who creates an account and uses the Service
• “Service” — the PreViral.ai web application and all its features
• “Content” — any data, text, images, videos, or other material you submit to or generate through the Service
• “AI Output” — any content generated by our artificial intelligence systems, including scores, analyses, scripts, and enhanced thumbnails
• “Subscription” — a paid plan that provides access to premium features

2. Account Registration

• You must be at least 16 years of age to create an account (in accordance with GDPR Art. 8 and COPPA requirements).
• You must provide a valid email address and verify it through our confirmation process.
• You are responsible for maintaining the security of your account credentials.
• One account per person. Sharing account credentials is not permitted.
• You must provide accurate and complete registration information.

3. Service Description

PreViral.ai provides the following features for video content creators:

1. PreViral Score — AI-powered prediction scoring for video content ideas
2. PreViral Analysis — Deep video analysis with framework-based scoring
3. PreViral Pulse — Real-time trend discovery across niches
4. PreViral Blueprint — AI-generated content scripts and production plans
5. PreViral Visuals — Thumbnail analysis and AI-powered enhancement

4. Subscription Plans & Pricing

We offer four subscription tiers:

• All prices are in US Dollars (USD) and exclude applicable taxes. VAT or other sales taxes will be calculated and displayed at checkout.
• We reserve the right to change prices with at least 30 days' notice. Price changes do not affect existing subscriptions until the next renewal.

5. Payment & Billing

• All payments are processed securely through Stripe. We do not store your payment card details.
• Paid subscriptions automatically renew at the end of each billing period (monthly or annually).
• You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period — you retain access until then.
• The maximum cancellation notice period is one month before the end of the current billing period.
• Failed payments may result in temporary suspension of premium features. We will notify you and attempt to retry the payment before any suspension.

6. Right of Withdrawal

As a consumer within the European Union, you have a 14-day right of withdrawal for paid subscriptions. For complete details, please see our Right of Withdrawal page.

If you request that the service begins immediately during the withdrawal period, you acknowledge that you may owe a proportional amount for services already provided.

Loss of Withdrawal Right: PreViral.ai is a digital service that generates and delivers digital content not supplied on a physical medium (AI-generated scores, analyses, scripts, and enhanced thumbnails). In accordance with §356(5) BGB, your right of withdrawal expires when: (a) you expressly consent to the immediate commencement of the service, (b) you acknowledge the loss of your withdrawal right, and (c) we provide you with confirmation of your consent on a durable medium (e.g., order confirmation email). This consent is obtained via a separate, clearly labeled confirmation during the checkout process.

Consent to Immediate Performance: During the checkout process, you will be asked to expressly consent to the immediate commencement of the service and to acknowledge that this consent causes your withdrawal right to expire. This consent is required before your paid features are activated. You will receive confirmation of this consent in your order confirmation email.

7. Cancellation

• You may cancel your subscription at any time through your account dashboard.
• Cancellation takes effect at the end of your current billing period. You will retain full access to paid features until then.
• Upon cancellation, your account reverts to the Free plan.
• In accordance with §312k BGB, a cancellation button will be provided in your account settings.

8. AI-Generated Content Disclaimer

Important: AI-generated predictions, scores, analyses, scripts, and visual enhancements are estimates based on algorithmic analysis of patterns and data. They do not guarantee actual video performance, engagement, or virality.

• PreViral Score values are probabilistic predictions, not guarantees of outcomes.
• AI-generated scripts (Blueprints) are suggestions based on trend analysis. They should be reviewed, edited, and adapted before use.
• Thumbnail enhancements (Visuals) are AI-generated suggestions and may not be suitable for all use cases.
• Past performance patterns analyzed by our AI do not guarantee future results.
• You should use AI outputs as one of many tools in your content creation process, not as the sole basis for creative decisions.

9. User Obligations

As a user of PreViral.ai, you agree to:

• Use the Service only for lawful purposes and in compliance with these Terms.
• Not upload, submit, or analyze content that is illegal, harmful, or infringes on third-party rights.
• Not attempt to manipulate, reverse-engineer, or interfere with the Service's AI systems or APIs.
• Not use automated tools (bots, scrapers) to access the Service except through our official API.
• Not share, resell, or redistribute your account access or AI outputs for commercial resale purposes.
• Take responsibility for all content you upload to or generate through the Service.

10. Intellectual Property

• Your Content: You retain all intellectual property rights to content you upload to the Service (videos, thumbnails, descriptions).
• Our Service: PreViral.ai, its software, algorithms, AI models, design, and branding are the intellectual property of Turgay Arslan. All rights reserved.
• AI Outputs: You receive a non-exclusive, worldwide license to use AI-generated outputs (scores, scripts, analyses, enhanced thumbnails) for your personal and commercial content creation purposes. We do not claim ownership of AI outputs generated from your content.
• License Grant: By using the Service, you grant us a limited, non-exclusive license to process your content solely for the purpose of providing the Service features.

11. User Content & Copyright

• You represent and warrant that you own or have the necessary rights to all content you submit for analysis.
• You are solely responsible for ensuring that content you analyze does not infringe on any third-party copyrights, trademarks, or other intellectual property rights.
• You agree to indemnify and hold us harmless from any claims arising from your submission of infringing content.
• Text and Data Mining (§44b UrhG): Our analysis of video content is performed within the scope of the text and data mining exception under German copyright law. We access only metadata through official platform APIs. We do not download, store, or redistribute video files or copyrighted video content.

12. AI Output Labeling (EU AI Act Art. 50)

• In accordance with the EU AI Act (Regulation (EU) 2024/1689), you are required to disclose AI-generated content when publishing or distributing it.
• If you use AI-generated scripts (Blueprints) or enhanced thumbnails (Visuals) in your published content, you should label them as AI-assisted or AI-generated as required by applicable law.
• PreViral.ai labels all AI-generated content within the application. When you use this content outside the platform, the labeling responsibility transfers to you.

13. Liability Limitation

Our liability is limited as follows, to the extent permitted by law:

• We are liable without limitation for damages caused by willful misconduct (Vorsatz) or gross negligence (grobe Fahrlässigkeit). This liability cannot be excluded or limited (§309 Nr. 7 BGB).
• For slight negligence, we are only liable for breach of essential contractual obligations (Kardinalpflichten). In such cases, liability is limited to the foreseeable, typically occurring damages.
• We are not liable for indirect or consequential damages, loss of profit, or loss of data, except in cases of willful misconduct or gross negligence.
• We are not liable for the accuracy of AI-generated predictions, scores, or analyses. AI outputs are probabilistic and do not constitute guarantees.
• As a sole proprietorship (Einzelunternehmen), the operator bears personal and unlimited liability as prescribed by law.
• These limitations do not apply to liability for damages arising from injury to life, body, or health, or under the German Product Liability Act (Produkthaftungsgesetz).

14. Warranty & Digital Product Compliance

As a provider of digital products under §§327-327u BGB:

• We warrant that the Service will conform to its description and be suitable for its intended purpose as described in Section 3.
• An AI prediction score that does not match actual video performance does not constitute a defect. Predictions are probabilistic estimates based on historical data and algorithmic analysis, not guarantees.
• Update Obligation (§327f BGB): We will provide necessary security updates and functional updates for the duration of your subscription. We will inform you of available updates.
• Warranty Period: For ongoing subscriptions, the warranty period equals the subscription duration. For defects that existed at the time of provision, the limitation period is the statutory period.
• Burden of Proof (§327k BGB): If a defect becomes apparent within one year of provision, it is presumed to have existed at the time of provision, unless this presumption is incompatible with the nature of the digital product or the defect.
• These warranty rights cannot be excluded or limited in our terms for consumers.

16. Changes to Terms

• We may modify these Terms from time to time. We will notify you of any material changes at least six (6) weeks before they take effect.
• Notification will be sent to the email address associated with your account.
• If you do not agree with the changed Terms, you have the right to terminate your subscription before the changes take effect (Sonderkündigungsrecht).
• If you do not object to the modified Terms within six (6) weeks of receiving the notification, the modified Terms shall be deemed accepted. We will specifically inform you about this legal consequence in the change notification.

17. Governing Law

These Terms are governed by the laws of the Federal Republic of Germany.

If you are a consumer residing in the European Union, you also enjoy the protection of the mandatory provisions of consumer protection law of your country of residence (Art. 6 Rom-I-VO / Regulation (EC) No 593/2008). In case of conflict, the provision more favorable to the consumer shall apply.

18. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The statutory provisions shall apply in place of the invalid or unenforceable provision.
